Film Emporium Terms and Conditions For more information please contact us directly. Shipping Information We ship all orders via FED EX Ground and FED EX AIR. Please note that FED EX services operate Mon-Fri., excluding major US holidays. Shipping charges will be added to all orders based on product weight and are discounted. Please click here for a sample pricing chart. Shipments are sent out from our New York and Los Angeles locations. While it our every intention to ship goods on a same day basis, it is recommended that you allow 1 business days for orders to be processed. For orders that must go out the same day, we request that customers call the main office in New York (800) 371-2555 to receive confirmation. Please note that shipping timeframes are calculated from the day the package leaves our warehouse, not from the day the order was placed. Once packages are in transit, please refer to the terms & conditions of FedEx: www.fedex.com Payment Information, Order Acceptance All major Credit Cards are accepted: American Express, Visa, Mastercard and Discover. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Film Emporium reserves the right at any time after receipt of your order to accept or decline your order for any reason or to supply less than the quantity you ordered of any item. All orders must obtain pre-approval by electronic or manual means with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order. Credit card authorization for Film/ Video orders above $500.00 Customer Acceptance Customer's receipt of products purchased from Film Emporium constitutes acceptance of terms and conditions noted here. In Store Pickup Film Emporium offers the option of picking up your order from one of our two offices. If you would like to take advantage of this option, simply select store pickup as your shipping method when your checking out. Returns All film and video tape sales are final, due to the sensitive nature of the raw material. Returns are at the sole discretion of Film Emporium and are subject to a 25% resticking fee. All Inquiries should be directed to 800-371-2555. Please note that all items returned for a refund must be returned in "as new" "unopened" condition in the original packaging and include all accessories, blank warranty cards, UPC codes (attached), and user manuals. Shipping back to our warehouse is the Customers responsibility unless the product is Damaged. Out-of-Stock Products We will ship your product as it becomes available. Usually, products ship the same day if ordered by 3:00PM Eastern Standard Time, or by the next business day if your order is received after this time and for orders received on Saturday, Sunday or any major holiday. However, there may be times when the product you have ordered is out-of-stock which will delay fulfilling your order. We will keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment. You may cancel your order at any time prior to shipping. Taxes Film Emporium shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within New York. For orders shipped to other states, you are solely responsible for all sales taxes or other taxes. For purchases shipping outside the United States, you are responsible for any taxes and duties required or imposed by any governmental authorities. Resale certificates and tax exemption forms should be submitted at the time of placing the orders. Typographical Errors In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, we have the right to refuse or cancel any orders placed for product listed at the incorrect price. We have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. Most items sold by Film Emporium are covered by manufacturers' warranties. When the item has a manufacturer's warranty, and/ or the warranty period has expired, calls for service or repairs should be referred directly to the manufacturer or their authorized service centers. Film Emporium shall not be responsible for any commercial damages, when incidental or consequential or otherwise that results from defective product, any late, misdirected or incorrect shipments. Film and tape media items will be replaced if defective in manufacture, labeling, or packaging, or if lost by us. Except for such replacement, the sale, processing, or other handling of material is without warranty of liability even though defect, damage, or loss is caused by negligence or other fault. In addition, color film will not be replaced for, or otherwise warranted against, any change in color. Film Emporium fully cooperates with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we reasonably believe to be unlawful. Film Emporium utilizes strict measures to control fraud. We reserve the right to refuse processing orders if fraudulent activities are suspected. Privacy We keep your personal information private and secure. When you make a purchase from our site, you provide your name, email address, credit card information, address, phone number, and a password. We use this information to process your orders, to keep you updated on your orders and to personalize your shopping experience.
